Acceptance of Terms

In these terms, “ADLS” means The Association of Dunkirk Little Ships.

By using this website, you agree to these Terms of Use and applicable law.

Permitted Use

You may view and use this website for lawful, personal, or informational purposes related to ADLS activities.

You must not misuse the site, interfere with security, or attempt unauthorised access.

Registration Declarations

When registering for an account, users must confirm they have read the Privacy Notice, the ADLS Constitution, and these Terms and Conditions of Use.

If these declarations are false or materially misleading, ADLS may suspend or terminate access in accordance with applicable rules and law.

Intellectual Property

All intellectual property rights in site content are reserved unless expressly stated otherwise.

Third-Party Platforms and Providers

ADLS relies on third-party software and infrastructure providers for communications, hosting, administration, analytics, archival handling and operational continuity. These may include Constant Contact, Microsoft, Amazon Web Services (AWS), Google and Wix-related systems.

Use of this website may involve processing by such providers subject to their systems and our contractual/operational controls.

Shop, Payments and Bank Data

Where you place orders or make payments, ADLS processes order and transaction data required for fulfilment, accounting, reconciliation, fraud management, refunds and legal obligations.

Payment and bank-related processing may involve third-party processors and financial service providers. ADLS does not intentionally store full payment card sensitive authentication data on this website.

Order Formation, Pricing and Payment

All orders are subject to acceptance by ADLS. Submission of an order does not guarantee acceptance.

Orders must be paid in full in advance before dispatch. ADLS is not obliged to reserve, dispatch or release goods until cleared payment is received.

ADLS may refuse, cancel or limit any order for any lawful reason, including stock availability, pricing or listing error, suspected fraud, delivery constraints, compliance concerns, or operational reasons. Where payment has been taken for a cancelled order, an appropriate refund will be made to the original payment method.

If a pricing, description or postage error is identified, ADLS may cancel or correct the order before dispatch and contact the customer with options where appropriate.

Title to goods passes only when ADLS has received cleared payment in full. Risk passes on delivery unless otherwise required by law.

Shipping and Delivery Terms

Delivery dates and timeframes are estimates only and are not guaranteed unless expressly agreed in writing.

Customers are responsible for providing accurate delivery information. ADLS is not responsible for delay, loss or additional cost caused by inaccurate or incomplete address details provided at checkout.

If postage paid is incorrect, insufficient, or based on incorrect delivery information, ADLS may reject, hold, or cancel the order, or require payment of the additional postage/handling amount before dispatch.

Where an item is returned to ADLS due to failed delivery, refused delivery, or non-collection, ADLS may require additional postage before re-dispatch.

Customers are responsible for any applicable customs duties, import taxes, clearance fees or local delivery charges unless expressly stated otherwise.

Returns, Cancellations and Refunds (Shop)

Unless otherwise stated, return requests should be made promptly and in any event within applicable legal time limits after receipt.

Return postage costs are not covered by ADLS except where required by law or where goods are confirmed faulty, damaged in transit, misdescribed, or incorrectly supplied by ADLS.

Customised, personalised, bespoke, made-to-order, or otherwise non-resale items are non-returnable and non-refundable, except where required by law (for example, where faulty).

Refunds (where due) are processed to the original payment method after return inspection and confirmation of eligibility.

If a chargeback or payment dispute is raised without valid basis, ADLS may suspend fulfilment and/or future ordering access pending investigation.

User Content and Image Submissions

Any text, images, video, documents, comments, captions, historical notes or other material submitted by a user is treated as user-generated content (UGC).

By submitting UGC, the user confirms they are solely responsible and legally liable for that content, including its accuracy, legality, and any consequences arising from publication.

By submitting UGC, the user grants ADLS a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt, edit for house style, publish, display, distribute, and archive the material for Association, memorial, historical and educational purposes.

Content Standards, Style and Language Requirements

UGC must be clear, factual where factual claims are made, and written in respectful language suitable for publication in a historical and commemorative context.

ADLS may edit spelling, grammar, formatting, house style, headings, punctuation, offensive wording, and presentation without prior notice.

UGC must not include defamatory statements, unlawful allegations, harassment, hate speech, discriminatory language, explicit content, or material that could reasonably damage the reputation of individuals, families, vessels, organisations, or the Association.

UGC must not include misleading statements presented as fact, fabricated records, impersonation, or knowingly false attribution.

Copyright, Permissions and Intellectual Property Warranties

The user warrants that they own the rights in the UGC or have obtained all necessary permissions, licences, consents and legal authority to submit and permit publication.

The user warrants that submission and publication of UGC will not infringe copyright, database rights, moral rights, privacy rights, image rights, trademark rights, confidentiality obligations, or any other third-party rights.

Where identifiable persons appear in submitted images or media, the user is responsible for ensuring they have a lawful basis and any required permissions for submission and publication.

If requested by ADLS, the user must provide evidence of rights ownership or permission. Failure to provide satisfactory evidence may result in removal or refusal of publication.

Moderation, Takedown and Enforcement

ADLS may review, refuse, edit, unpublish, suspend, or permanently remove UGC at any time and for any lawful reason, including legal risk, policy breach, third-party complaint, or reputational concern.

ADLS is not obliged to publish any submitted content and is not required to provide reasons for refusal or removal.

ADLS may preserve moderation and submission records, including logs and correspondence, for legal, safeguarding, governance, and dispute-handling purposes.

Account Restriction and Termination

ADLS may suspend, restrict or terminate accounts and access rights for breach of these terms, policy non-compliance, legal risk, suspected fraud, abusive behaviour, or operational/security reasons.

ADLS may remove listings, submissions, orders or user access where necessary to protect the Association, members, contributors or third-party rights.

User Liability and Indemnity

The user accepts full legal responsibility for UGC they submit and any resulting claims, losses, liabilities, damages, penalties, costs or expenses.

To the fullest extent permitted by law, the user agrees to indemnify and hold harmless ADLS, its officers, committee members, volunteers and agents from and against any claim or legal action arising from that user’s UGC, including alleged infringement, defamation, privacy breach, unlawful processing, or misrepresentation.

Where ADLS incurs legal or professional costs due to a user’s UGC, ADLS may seek recovery of those costs from the responsible user to the extent permitted by law.

Consumer Statutory Rights

Nothing in these terms is intended to exclude or limit rights that cannot be excluded under applicable law, including consumer protection legislation in force in England and Wales.

This website includes third-party links. ADLS is not responsible for external website content, availability, or privacy practices.

Liability and Jurisdiction

The site is provided on an “as is” basis. To the fullest extent permitted by law, ADLS excludes warranties and limits liability for indirect or consequential loss.

ADLS is not responsible for the legality, accuracy, ownership or reliability of user-generated or third-party submitted content; responsibility remains with the submitting party.

ADLS is not liable for delay or failure caused by events beyond reasonable control, including supplier failure, transport disruption, cyber incidents, extreme weather, strikes, or governmental action.

If any part of these terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These terms constitute the entire agreement for website/shop use to the extent applicable and may be amended by ADLS from time to time by publication of updated terms.

These terms are governed by the laws of England and Wales.
